The present General Conditions of Sale are those of the company DC Concept, Société par Actions Simplifiée with a capital of 10. 000 €, in the process of being incorporated, whose registered office is located at 355 rue Pierre Simon Laplace 13290 Aix-en-Provence, France, represented by Mrs. Marie VENTURA-CECCALDI, registered in the Trade and Companies Register of Aix-en-Provence under the number B 891 447 443, whose intra-community VAT number is FR58891447443 and whose registered office is located at 355, rue Pierre Laplace 13290 Aix-En-Provence, France
Scope and acceptance of the General Terms of Sale
The purchase of Products proposed on the internet site www.dimensioncachee.com/ (hereafter the ” Site “) is subjected to the present general conditions of sale of the Site (hereafter the ” CGV “).
The DIMENSION CACHEE Products (hereafter the ” Products “) are exclusively intended to be sold to final consumers natural persons or clients non-professional legal entities (hereafter the ” Clients “), to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the Client affirms that he acts as a final consumer and that he does not intend to resell the Products for commercial purposes.
DIMENSION CACHEE can at any time update these CGV.
The Customer can take note at any time of the version of the CGV in force by clicking on the link https://www.dimensioncachee.com/fr/legals/conditions-generales. The CGV in force at the time of the conclusion of the sale contract are those which are opposable to the Customer.
In addition, for each purchase of Products on the Site, the Customer will be asked to confirm acceptance of these GTC in force on the date the order is placed. The said GTCs can be viewed at the time the Customer is asked to confirm acceptance. To materialize this acceptance, the Customer will have to check the box “I have read and accept the General Conditions of Sale of the dimensioncachee.com website”.
Terms of Order
Any order placed on the Site is worth express acceptance of the GCS and is worth acceptance of the prices and the Products available with the sale on the Site.
The Customer who wishes to place an order must follow the following procedure:
3.1 Product selection: the Customer must select the Product he/she wishes to order.
3.2. Checking the contents of the Customer’s selection: the Customer checks the contents of his basket while keeping the possibility of deleting the Products he has selected.
3.3. Verification of the Customer’s order: the Customer verifies the content of his order, the total price, the delivery and billing addresses while keeping the possibility of deleting a Product or modifying the billing and delivery address. The customer validates his mode of delivery and payment. By validating his order, the customer accepts the present general conditions of sale.
3.4. Acknowledgement of receipt of the order: the Customer receives an e-mail summarizing the contents of his order, namely
– his delivery and billing addresses
– the order number
– the date of the order
– the list of ordered Products and their amounts
– the delivery method (address provided by the Customer or “point relay” etc.)
The Customer is advised to keep and print this document, which is the official proof of the order. The order is then registered and treated by DIMENSION CACHÉE which verifies the availability of the ordered Product(s). Any placed order is worth acceptance of the prices and descriptions of the Products available for sale.
Confirmation of the sending of the order: the Customer receives an e-mail recapitulating the content of his order and confirming the sending. The contract is deemed to be concluded on the date this e-mail is sent.
Follow-up of the order
A tracking number of the carrier is communicated to the Customer when the order is validated.
If the Customer wishes to obtain information concerning the follow-up of his order, he can connect on the internet site of the carrier chosen by DIMENSION CACHÉE, ex: UPS, at the address www.ups.com, and follow directly the routing of his parcel. The Client receives information by e-mail concerning the different steps of the process of treatment and preparation of his order until its expedition.
The offers of Products and prices of DIMENSION CACHÉE are valid as long as they are visible on the Site, within the limit of available stocks.
Errors or modifications can exceptionally exist, notably in the case of simultaneous orders of the same Product by several Clients.
In the eventuality of an unavailability of the Product after placing the order, DIMENSION CACHÉE will inform the Client by e-mail or by telephone as soon as possible, proposing him either to order another Product presented on the Site as a replacement, or to cancel his order without costs.
DIMENSION CACHÉE does not incur any responsibility in case of stock shortage or unavailability of the Products for orders not yet accepted by the DIMENSION CACHÉE
DIMENSION CACHÉE reserves the right to change at any time and without notice the Products proposed on the Site.
In order to assure a better quality of service and availability of its Products to all the Clients of the Site, DIMENSION CACHÉE reserves the right to limit the quantity of Products that can be bought by a Client, in conformity with the applicable dispositions in the matter and notably those of the Article L.121-11 of the French Code of Consumption.
If all the efforts are made to assure that the color and the pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations can intervene, notably because of the technical limitations of the rendering of the colors on the computer equipment of the Client. Consequently, DIMENSION CACHÉE cannot be held responsible for errors or inaccuracies that are not substantial in the photographs or the graphic representations of the Products appearing on the Site.
DIMENSION CACHÉE reserves the right not to accept an order from a Client with whom it is in litigation for a previous order, or if DIMENSION CACHÉE reasonably believes that this Client has violated the present CGV or that he has engaged in a fraudulent activity, or for any other legitimate reason.
The prices of the Products are indicated in Euros, all taxes included and without possible customs fees for the orders outside the EU which remain at the charge of the Client. Apart from the cases of reimbursement carried out (i) within the framework of the exercise of the right of retraction or for (ii) lack of conformity and hidden defects, DIMENSION CACHÉE will not reimburse the VAT applied on the purchases made on the Site (even in the case where the buyer, after reception, sends the Products back to a country outside the European Union).
DIMENSION CACHÉE reserves the right to modify at any time and without notice the prices of the Products proposed on the Site.
The Products are invoiced on the basis of the tariffs displayed on the Site at the moment of the placing of the order, subject to the availability of the ordered Products at this moment.
All orders are payable in Euros and must be paid immediately when the order is placed.
In case of unavailability of certain Products ordered (see Article 4 “Availability of Products”), only the price and shipping costs related to the available Products will be charged.
By credit card (Visa, CB, Mastercard, American Express): The payment is made on the secured site of the banking establishment partner of DIMENSION CACHÉE.
By payment application: via Paypal.
This implies that no banking information concerning the Client transits via the site www.dimensioncachee.com
The payment is thus secured by the partners in charge of managing the financial transactions.
The order will be registered and validated as soon as the payment is accepted by the banking service.
Reservation of ownership
The ordered Products remain the property of DIMENSION CACHÉE until the complete collection of the price by DIMENSION CACHÉE. On the other hand, the Customer assumes the risks (notably of loss, theft or deterioration) concerning the delivered Products from the moment when they are delivered to the address indicated during the order.
Terms of delivery
The amount of preparation and shipping costs depend on the country and the total amount of the order. They will be detailed on the invoice.
DIMENSION CACHÉE cannot be held responsible for any action and/or expenses and/or taxes (which are the responsibility of the Customer) and/or delays due to the customs services over which it has no control.
For the whole of the Products, the order is prepared for a departure of the warehouses of DIMENSION CACHÉE within a maximum delay of 3 working days (under reserve of availability of stocks and except for the particular case of the Products sold ” in pre-order ” whose card indicates the specific estimated delay of delivery) as from the confirmation by e-mail of the order. The average time between placing an order and its delivery is 4 to 9 working days. This is an average time noted.
As an exception to the above-mentioned times, “pre-order” operations may be subject to longer delivery times. In this case, the estimated delivery time for “pre-order” operations may be 6 to 9 months from the time of the order as duly indicated in the purchasing process.
Exceeding the estimated delivery time indicated cannot give rise to any cancellation of the order, to any reduction in the price paid by the buyer and to any payment of damages, it being specified that in certain particular cases (e.g.: products marketed as “pre-orders”) the times indicated above may be longer. However, in the absence of delivery after 30 days from the estimated maximum time, the Customer will have the possibility to proceed to the cancellation of the order without expenses. The sums paid will then be refunded to him. In the cases where it has the capacity, DIMENSION CACHÉE reserves the possibility to propose to the Customer a Product of quality and price equivalent to the initial product.
If the order reaches a certain volume, DIMENSION CACHÉE will be able to send them to the Client in several deliveries and/or several packages.
The Customer must verify the conformity of the delivered Products at the moment of the delivery and before signing the delivery note of the carrier. The Customer must indicate on the delivery note and in the form of handwritten reservations accompanied by his signature any anomaly concerning the delivery (damaged Product…). This verification is considered to have been carried out as soon as the Customer, or a person of his choice, has signed the delivery note. No claim on the condition of the delivered package(s) will then be admissible. In case of reserves on the delivery, the Customer must also confirm them to the carrier at the latest in the 3 working days following the reception of the article(s) and transmit a copy of this mail to DIMENSION CACHÉE by email to the address email@example.com with confirmation by registered letter with acknowledgement of receipt to the customer service at the following address Société DC CONCEPT – 355 rue Pierre Simon Laplace 13290 Aix en Provence – FRANCE.
In case of incomplete address, wrong address, refusal of the parcel by the addressee or lack of information leading to an impossibility to deliver the Product to the addressee in time, DIMENSION CACHÉE cannot be held responsible for the final quality of this delivery. If this lack of information leads to a second presentation to the addressee, DIMENSION CACHÉE will be entitled to ask the Client for the costs corresponding to this second delivery. The Customer is subjected to the general conditions of delivery of the carrier which, in certain cases, if he does not comply with them, can impact the quality of the delivery.
Thus, in case of absence of the addressee, according to the general conditions of delivery of the carrier, the product can be presented again and/or deposited in an agreed relay point and/or in front of the Customer’s home and/or in a center of “sorting – waiting” of the carrier and/or sent back to DIMENSION CACHÉE which cannot be held responsible for any theft, loss, damage on the Products in relation to their delivery and, in a general way, of the final quality of the delivery.
In the hypothesis of an impossibility of delivery and if the product was then returned to DIMENSION CACHÉE by the carrier, DIMENSION CACHÉE will not make a new delivery.
Any complaint concerning the delivery of the Products must be formulated within 14 working days following the reception of the article(s) in the same conditions as mentioned above. If it is decided that the product(s) must be sent back to DIMENSION CACHÉE, they will have to be returned in their original state (packaging, accessories…) and according to the following conditions of expedition. The Customer will have to contact beforehand the customer service via the mail : firstname.lastname@example.org in order to obtain a return number to be noted on the form ” Return form ” joined to the order as well as any precision relative to the expedition. No package will be accepted without a return number. This number must be written legibly on the package with a marker. The Product must be returned to the attention of DC concept dimension cachee: address :

Right of retraction
In accordance with articles L. 121-16 and following of the Code of consumption, the Customer has a 14 days deadline as from the day of the delivery of the product bought on the Site to warn the customer service of the will to return the Product.
For any return, the Customer must
i) use the return form enclosed inside the delivery package or by e-mail or
ii) contact the customer service via the email: email@example.com to inform them of their decision to use their right of withdrawal. Any parcel returned beyond the announced deadlines, will be refused and sent back to the sender. No parcel returned in against-refunding will be accepted, whatever the reason. The costs and risks related to the return of the Products are the responsibility of the sender. In order for the customer service to accept the exchange and/or the refund, the Product must be returned complete in its original packaging, undamaged, with its label attached, not worn, accompanied by all its accessories and a copy of the purchase invoice to DC CONCEPT Company at the following address

ii) . The Client will not have to justify any motives nor pay any penalties, except for the return costs.
DIMENSION CACHÉE will not be responsible for the cases of loss, theft or damage of the parcel.
The parcels for which the identification of the Client (name, first name, address and return code) will not be possible, will be refused.
Any return must be done by a traceable method (UPS, FEDEX, DHL, RAR, etc…) and the tracking number must be communicated to DIMENSION CACHÉE.
At the reception of the Product sent back by the Client, the customer service will send by email a confirmation of reception of the Product.
DIMENSION CACHÉE, in case of regular exercise of this right by the Client, will reimburse to the latter the sums paid by him corresponding to the acquisition of the returned Product(s) (thus excluding the possible customs fees), within a maximum delay of fourteen days, by bank transfer to the account used with the payment card addressed to the name of the Client.
The Products sold by DIMENSION CACHÉE are subjected to the conditions of legal guarantees foreseen by the articles L.217-4 to L.217-14 of the Code of the Consumption as well as by the articles 1641 to 1648 of the Civil Code, excluding all other guarantees:
DIMENSION CACHÉE will refuse any claim concerning Products that have been used in an inappropriate way.

*Legal guarantee of conformity:
DIMENSION CACHÉE will deliver to the Client a Product in conformity with the contract and free of conformity defects at the time of the delivery of the aforementioned Product, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will present the characteristics presented during the sale. DIMENSION CACHÉE is also responsible for the defects of conformity resulting from the packaging, the assembly instructions or the installation when this one has been put at its charge by the contract or has been realized under its responsibility.
Legal guarantee of hidden defects:
DIMENSION CACHÉE will give the Client a Product free of hidden defects which would make it unfit for the use for which it is destined, or which diminish so much this use, that he would not have acquired it, or would have given only a lesser price, if he had known them.
These warranties shall only apply if the Customer makes the request within 24 months of delivery of the Product (for the legal warranty of conformity) or of the discovery of the defect (for the legal warranty of hidden defects).
Conformity defects that appear within 24 months of delivery are presumed to exist at the time of delivery, unless proven otherwise.
In case of recognized non-conformity on a Product sold by DIMENSION CACHÉE, the Client will be able to choose between the repair or the replacement of the Product, except if one of these choices entails a manifestly disproportionate cost for DIMENSION CACHÉE. If the repair or the replacement of the Product is impossible, the Client can be refunded the price paid and return the Product or keep the Product and be refunded a part of the price, except if the defect of conformity is minor.
In case of hidden defect recognized on a Product sold by DIMENSION CACHÉE, the Client will have the choice to return the Product and to have the price and the expenses caused by the sale restituted or to keep the Product and to have a part of the price restituted.
In all cases, it will be up to the Customer to prove that he/she meets the conditions of the guarantee.
The return, replacement or reimbursement of the Product will be free of charge for the Customer and does not prevent the possible allocation of damages in the event that the Customer is entitled to them.
In case of defect of conformity and/or hidden vices recognized by DIMENSION CACHÉE, if it is decided to return the Product, the Client will have to send it to the following address Company DC CONCEPT – customer service – 355 rue Pierre Simon Laplace 13290 Aix En Provence. The Customer will have to have previously obtained from the customer service contacted via the email : email@example.com a return number as well as any precision relative to the shipment. No package will be accepted without a return number. This number will have to be written with a marker in a legible way on the parcel.
Limitation of liability
In no case, the responsibility of DIMENSION CACHÉE can be engaged for any damage which would not result from a failure of DIMENSION CACHÉE to one of its obligations.
When the Customer orders via the Internet site www.dimensioncachee.com, DC CONCEPT (DIMENSION CACHÉE) collects his personal information (personal data, e-mail address, sex…) by the means of the process of order in order to offer him the accessible services of DIMENSION CACHÉE. The information of the nominative information concerning him are essential for the treatment and the delivery of his orders.
They will be treated in the strict respect of the dispositions of the Law ” Informatique et Libertés ” n°78-17 of January 6th, 1978 and the regulation (EU) 2016/679, general regulation on the protection of the data.
For this reason, DIMENSION CACHÉE commits itself notably to
(i) to guarantee the confidentiality of the personal data treated in the framework of the present by implementing the appropriate security measures in its field of activity,
(ii) to ensure that persons authorized to process personal data hereunder undertake to respect confidentiality or are subject to an appropriate legal obligation of confidentiality and receive the necessary training in the protection of personal data, and
(iii) that his possible subcontractors respect the legal obligations for the account and according to the instructions of DIMENSION CACHÉE.
At any time, the Customer has a right of access, modification, rectification and deletion of the data which concern him. To exercise this right, he can make the request to DIMENSION CACHÉE by email at the address firstname.lastname@example.org or by mail at the following address Company DC CONCEPT – 355 rue Pierre Simon Laplace 13290 Aix en Provence – FRANCE.
Under reserves of validation by an ” opt-in ” of the customer, the personal information (personal data, e-mail address, sex…) can also be used by DIMENSION CACHÉE and/or its partners for commercial purposes such as the sending of newsletters or solicitations.
The Policy of management of the personal data of DIMENSION CACHÉE is accessible on the Site.
All the documents, information texts, graphics, images, photographs or any other content diffused on the Internet site www.dimensioncachee.com are the exclusive property of DIMENSION CACHÉE. Consequently, they can neither be reproduced, nor exploited, nor used for any reason whatsoever, without the express authorization of the director of the publication.
DIMENSION CACHÉE is the holder of all the intellectual property rights (except for the moral rights of the authors) related to the Products and to the brands and distinctive signs under which the Products are commercialized.
The Customer recognizes without reserve as such the intellectual property of DIMENSION CACHÉE and commits himself not to attack it in any way. More specifically, the Customer expressly commits himself not to manufacture, sell, give in license or commercialize in any way whatsoever, directly or by the intermediary of a third party, for his own profit or for the profit of a third party, the Products, the imitations or reproductions of the Products or the intellectual property rights pertaining to the Products and the brands belonging to DIMENSION CACHÉE.
“Force majeure” designates all the external, irresistible and unforeseeable circumstances, out of the reasonable control of the party who suffers a case of force majeure.
In the hypothesis where the DIMENSION CACHÉE would be prevented or delayed by a case of force majeure in the execution of its commitments, the DIMENSION CACHÉE commits itself to inform the Client within 96 hours by specifying the precise elements constituting the force majeure, the reasonably foreseeable duration of the delay or of the prevention. In such a case of force majeure, DIMENSION CACHÉE will be able to terminate the order or any part of it, without any responsibility, however, it will have to reimburse the Client for the sums already paid. In no way, the Customer will be able to invoke a case of force majeure to free himself even temporarily from an obligation of payment of a sum of money.
Applicable law – Litigation
The present General Conditions of Sale are governed and interpreted in accordance with French law. The language of this contract is French.
In the event of a dispute, the French courts shall have exclusive jurisdiction. However, in application of the EC Regulation 593/2008 of June 17, 2008, the present GCS do not prevent the application of a provision more favorable to the Customer, which cannot be derogated from by agreement, and this under the law of the country where the Customer has his usual residence.
In the event of a dispute related to the application and/or interpretation of these general terms and conditions of sale, the Customer has the possibility of resorting to a conventional mediation procedure or to any other alternative dispute resolution procedure. In accordance with the order n°2015-1033 of August 20, 2015 and the application decree n°2015-1382 of October 30, 2015, any dispute or litigation known as consumer, subject to article L.612-2 of the Consumer Code can be the subject of an amicable settlement by mediation with the CMAP – Centre de Médiation et d’Arbitrage de Paris. To submit a dispute to the mediator, the Customer can (i) fill in the form on the CMAP website: www.cmap.fr tab “you are: a consumer” (ii) send his request by simple or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to email@example.com. Whatever the means used to seize the CMAP, the request of the Customer must contain the following elements to be treated with rapidity: his postal, email and telephone coordinates as well as the complete name and address of DIMENSION CACHÉE, a succinct statement of the facts, and the proof of the previous steps taken with DIMENSION CACHÉE.
Notwithstanding what precedes, in case of litigation, and in accordance with the Regulation n° 1215/2012 of December 12, 2012 :
– the Customer can seize either the court of his residence, or the French courts,
– DIMENSION CACHÉE will be able to seize the court of the place of residence of the Customer.
